Meritorious

Public Funding may not be justified, if for instance, there is little chance of succeeding, or it is a frivolous or a disproportionate matter.

Scope

legal aid must be available for the legal area you need assistance with. Click here for detailed guidance on the criteria for each area and the required proof you will need to take to a solicitor. In summary though:-

Divorce

This is essentially available if you are a victim of domestic violence.

Finances on Divorce | Civil Partnership Dissolution

The same criteria as with divorce applies.

Children

The same criteria as with divorce applies. Advice can also be sought where a Child is at risk of abuse from someone else and in matters of Child Abduction and Care and Supervision Proceedings

Injunction

Advice on obtaining an injunction against someone else remains open for advice under Legal Aid without the need to provide any proof of Domestic Violence. You must still be financially eligible. It may be that letters can therefore be sent and or an application for the next level of Legal Aid Funding to make an application to court.

Mediation

Mediation is still available for free to those who are financially eligible, to assist in most family matters. It may be worthwhile therefore making a self referral to a local mediator.

If mediation proceeds to a session where you both attend, then at that point, Legal Aid is available to instruct a Solicitor on Children and Civil Partnership Dissolution Financial matters. We can advice you on the discussions taking place during mediation and in drafting any financial consent order agreed during the process.
