No win no fee personal injury claims

Pursuing a personal injury claim may not be as expensive as you first imagine.

If you have buildings, contents and/or motor insurance the policy may cover legal expenses in pursuing a claim for personal injury. Such legal expenses insurance may cover legal costs and expenses and if we are unsuccessful, your opponents costs and expenses as well.

What if I do not have legal expenses insurance?

We may act on your behalf without charging a fee unless your claim is successful, i.e we recover damages on your behalf. This is what is commonly called a "no win, no fee" agreement. In fact our costs and expenses are paid by your losing opponent.

However if you lose, although you will not have to pay our fees, you will probably have to pay all or part of your opponents costs and expenses. To cover this you need to take out insurance and to do so you would have to pay a premium. We can arrange insurance for you.

The insurance policy will pay the costs of your opponent if you lose but it may not pay the expenses of preparing your case as it goes along i.e medical reports, surveys, counsel's fees, court fees etc. These will have to be paid by you as the case progresses. If you succeed they should be paid by your opponent otherwise you are liable for the cost. However, once court proceedings are started, if you are then unsucessful those expenses may be reimbursed to you under the terms of the insurance policy.

To assist in paying for the insurance premium and for the cost of expenses we can arrange a loan facility, which only has to be paid once the case has concluded.

We are entitled to charge an additional fee if we win, called a success fee. This is normally a percentage increase in our basic fee. The success fee as well as the insurance premium should be recovered from your opponents if we are successful in pursuing your case. You will therefore receive your compensation in full.

There should no longer be any need for you not to be able to pursue a claim simply because you cannot afford to do so.
